Terms and conditions
This document defines the terms and conditions of our working relationship. All projects or services that iXLabs Designs may be contracted to produce or provide for clients will be subject to the following:
General
iXLabs Designs will only carry out work where an agreement is provided either by email, telephone or mail. iXLabs Designs will only carry out work for clients who are 18 years old or above. An 'order' is deemed to be a written or verbal contract between iXLabs Designs and the client, this includes telephone and email agreements.
Website Design
Whilst every effort will be made to ensure that the website and any scripts or programs are free of errors, iXLabs Designs cannot accept responsibility for any losses incurred due to malfunction of website or any part of it.
iXLabs Designs cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.
The client agrees to make available material as soon as reasonably possible to iXLabs Designs all materials required to complete the site to the agreed standard and within the set deadline. iXLabs Designs will not be held liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.
iXLabs Designs will not be held liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrong doing on the part of a site owner.
iXLabs Designs will not be held liable for any costs incurred, compensation or loss of earnings due to the unexpected maintenance or unavailability of the site, its servers.
Compatibility
iXLabs Designs will ensure that any developed/designed site or application will function correctly on the server it is initially installed on and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 6,7 and to an acceptable standard with Mozilla browsers. iXLabs Designs can offer no guarantees of correct function with all browser software.
Modifications / Alterations (Aftercare Service)
Any modifications, alterations to design work will be carried promptly once received. Modifications will be carried out free of charge until 3 months after the final balance has been received. iXLabs Designs has the right to refuse any free modifications to websites or applications when the date of the aftercare service has expired. Any changes made after will be charged at are standard rate.
Rights of Ownership
Once a project has been delivered by iXLabs Designs and is fully paid for by the client, iXLabs Designs will assign the copyright of the website for the use(s) described in the proposal. Until full payment has been received the copyright will still belong to iXLabs Designs.
Payment / Billing
Billing at iXLabs Designs is done in 2 stages, 1st stage is after quotation and proposal has been agreed a deposit 25% is required before any design work will be carried out. This figure is non-refundable. 2nd stage, It is iXLabs Designs policy that any outstanding payments for full project work carried out are required to be paid in full, no later than 30 days from the date of the invoice unless prior arrangement are made. Invoices will be dispatched when design is complete and agreed.
Once a deposit is paid and work completed you are obliged to pay remaining balance in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.
Complaints Procedure
Anyone who experiences a problem with their web service provided by iXLabs Designs should raise the matter directly using our Contact Form to do so, giving sufficient information to locate the material (Website URL) and clearly outlining the grounds for complaint.
iXLabs Designs will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.
Project Termination
The term of this agreement will continue for work in progress. If you wish to at any time to cancel, terminate or “put on hold” any previously authorized purchases, we will promptly do so, provided you pay for any costs incurred as a result.
